These Terms of Service ("Terms") govern your access to and use of the Build Margin platform, including our website, web application, mobile-responsive interfaces, and related services (collectively, the "Service"), operated by Build Margin Pty Ltd ("Build Margin", "we", "us", "our").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and have authority to bind your business to use the Service. The Service is intended for use by businesses operating in Australia and New Zealand.
2. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
One account = one organisation. You may not share login credentials. Each team member must have their own user account under your organisation.
3. Subscriptions, trials, and payment
The Service is offered on a subscription basis. We currently offer three plans — Free, Standard, and Pro — described at /pricing. All prices are in Australian dollars and include GST where applicable.
- Free trial. New accounts receive a 14-day free trial with Pro features. No credit card is required to start the trial. After the trial ends, you will be downgraded to the Free plan unless you provide payment details.
- Billing. Subscriptions are billed in advance, monthly or annually depending on the plan you choose. Annual plans receive a discount as shown at checkout. Payments are processed by Stripe.
- Renewal. Subscriptions renew automatically at the end of each billing period unless cancelled at least one day before renewal.
- Refunds. Monthly subscriptions are non-refundable. Annual subscriptions may be refunded on a pro-rata basis within 30 days of the renewal date if you have not used the platform.
- Price changes. We may change prices on renewal. You will be notified by email at least 30 days before any price change.
4. Acceptable use
You agree NOT to:
- use the Service for any unlawful purpose or in violation of Australian law;
- upload content you do not have the right to use (including copyrighted plans);
- attempt to reverse engineer, decompile, or extract source code from the Service;
- use automated tools to scrape data or overload our infrastructure;
- share or resell access to the Service without our written permission;
- use the Service to send spam, malware, or harmful content;
- impersonate another person or organisation.
We may suspend or terminate accounts that breach these rules without notice and without refund.
5. Your content
You retain ownership of all content you upload to the Service ("Your Content"), including PDF plans, estimates, supplier quotes, photos, and messages. You grant Build Margin a limited licence to host, process, and display Your Content solely as needed to provide the Service to you.
You are responsible for ensuring Your Content does not infringe third-party rights and does not contain illegal material.
6. AI features and accuracy
Build Margin uses artificial intelligence to assist with PDF takeoffs, quote analysis, schedule intelligence, and other features. AI outputs are estimates and suggestions — they are not guaranteed to be accurate, complete, or fit for any particular purpose.
You are responsible for reviewing all AI outputs before relying on them in a quote, contract, claim, or any decision with financial consequences. The AI Takeoff Engine provides confidence scores to help you judge reliability, but the final review is yours.
7. Service availability
We aim to provide 99.5% uptime, but the Service is provided on an "as is" and "as available" basis. We may need to perform maintenance, deploy updates, or respond to incidents — we will give reasonable notice for planned downtime.
8. Intellectual property
The Service, including all software, designs, text, graphics, and trademarks, is owned by Build Margin and is protected by Australian and international intellectual property law. These Terms do not grant you any rights in our intellectual property beyond the limited right to use the Service.
9. Third-party services
The Service integrates with third-party services including Stripe (payments), Anthropic (AI), Brevo (email), and others. Your use of those services is governed by their respective terms. We are not responsible for third-party service availability or failures.
10. Termination
You may cancel your subscription at any time from within the Service. Cancellation takes effect at the end of the current billing period. We may terminate your access for breach of these Terms, non-payment, or if we cease offering the Service.
On termination, your access to the Service ends. We will retain your project data for 30 days, during which you can request an export. After 30 days, project data is permanently deleted.
11. Australian Consumer Law
If you are a "consumer" under the Australian Consumer Law (ACL), nothing in these Terms excludes or limits any guarantee, right, or remedy you have under the ACL that cannot lawfully be excluded.
12. Limitation of liability
To the extent permitted by law, Build Margin's total liability to you under these Terms is limited to the total amount you paid us in the 12 months immediately before the event giving rise to the claim.
We are not liable for indirect, consequential, special, or incidental damages, including lost profits, lost data, or business interruption — even if we were aware such damages were possible.
13. Indemnity
You agree to indemnify Build Margin against any third-party claim arising from Your Content, your breach of these Terms, or your misuse of the Service.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified to account holders by email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws of Victoria, Australia. You and Build Margin submit to the exclusive jurisdiction of the courts of Victoria for any dispute arising under these Terms.
